Penalties For Multiple DWIs In Minnesota

Your previous record will have an enormous impact on the penalties you face. There are mandatory minimum sentences for multiple DWI convictions in Minnesota.

  • Second DWI conviction within 10 years: You will face a mandatory 30 days’ incarceration, 48 hours of which must be spent in jail or a workhouse. However, for each day less than 30 you serve, you will be required to perform eight hours of community service.
  • Third DWI conviction within 10 years: You will be incarcerated for a mandatory minimum of 90 days. At least 30 days of this time must be spent in jail or a workhouse.
  • Fourth DWI conviction within 10 years: There is a mandatory 180 days of incarceration for your fourth conviction. A minimum of 30 days of this time must be spent in jail or a workhouse.
  • Fifth DWI conviction within 10 years: A fifth conviction requires one year of incarceration, with at least 60 of those days spent in jail or a workhouse.

With a fourth conviction or greater, the charge will also be a felony. This means that you could spend up to seven years in prison and face up to $14,000 in fines.
