At Villaume & Schiek, our FMLA attorneys understand that your job is important to you – it’s a source of pride, identity and financial stability. However, we also recognize that life can present challenges that require your attention away from work, such as personal illness, family health emergencies or the birth or adoption of a child. The Family and Medical Leave Act (FMLA) was established to protect employees like you during these critical times, ensuring that you can take the necessary leave without fear of losing your job.

What Is The FMLA?
The FMLA is a federal law that allows eligible employees to take unpaid, job-protected leave for specified family and medical reason. The law provides for the continuation of group health insurance coverage under the same terms and conditions as if the employee had not taken leave. Eligible employees are entitled to 12 workweeks of leave in a 12-month period for:
- The birth of a child and to care for the newborn within one year of birth
- The placement with the employee of a child for adoption or foster care and to care for the newly placed child within one year of placement
- Caring for an immediate family member (spouse, child or parent) with a serious health condition
- A serious health condition that makes the employee unable to perform the essential functions of their job
Are You Covered?
Most public agencies, public and private elementary and secondary schools, and companies with 50 or more employees are covered by the FMLA. To be eligible, you must have worked for your employer for at least 12 months and have logged at least 1,250 hours of service during the 12 months prior to the start of the FMLA leave.
Special Considerations for Teachers, Nurses And Other Employees
Certain professions, such as teaching and nursing, are essential to the fabric of our society. Teachers mold young minds, and nurses care for us when we’re at our most vulnerable. Despite the critical nature of these roles, professionals in these fields often find their FMLA rights overlooked or violated by employers. This can happen through unintentional oversight or deliberate non-compliance with the law. The FMLA attorneys at Villaume & Schiek are here to ensure that your rights are recognized and upheld, whatever your profession may be.

Common Violations Of FMLA Rights
Unfortunately, FMLA rights are sometimes violated by employers. These violations can include:
- Denying a legitimate request for FMLA leave
- Unlawfully firing pregnant women during their FMLA leave
- Failing to notify employees of their FMLA rights
- Discouraging an employee from using FMLA leave
- Retaliating against an employee for taking FMLA leave
- Refusing to restore the employee to their original position or an equivalent one after the leave
- Counting FMLA leave under “no fault” attendance policies
